Trade mark registration process

MARKY helps you register your trade mark, facilitating the filing with the Trade Marks Office, and guiding you through the process to help you:

• choose your trade mark to file;
• select your goods and services (which we guarantee will be accepted); and
• enter the correct owner,

all of which are very important things.  If you do not do the process correctly then you could end up with something that is worthless, or at least not as good as what you thought it was or what it could be.  MARKY helps you to avoid that.  If you are still not sure what you should apply for, or if you want more help with the process, MARKY is here to help - just contact MARKY.

Once MARKY has filed your trade mark application the Trade Marks Office will examine it.  This is meant to be around 3 weeks, but is currently taking about 3 months.  

MARKY will let you know when the application has been examined and:

• if it has been accepted, it will be advertised to the public for a 3 month period in case someone wants to oppose it (if they think they have rights to it or that you should not); or
• if it has not been accepted, MARKY will let you know the reasons, and you can decide what to do (MARKY can also help with this).

Assuming it is accepted and the 3 month opposition period has expired (oppositions are statistically unlikely), the application will then be “registered” and MARKY will inform you of this.

Trade mark registrations last for 10 years and can be renewed for successive 10 year periods.

Prior to filing a trade mark application or commencing use of your brand, we recommend doing searches to help to identify any existing trade marks that may be similar to the brand you want to use.  An existing trade mark (registered or unregistered) that is similar to your proposed trade mark may affect the right to register and/or use the trade mark.  MARKY can facilitate this for you.
